NEST LEARNING THERMOSTAT GIVEAWAY OFFICIAL CONTEST RULES & REGULATIONS
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT WILL NOT INCREASE CHANCES OF WINNING. The Sponsors of the Contest is A.J. Perri Holdco, LLC (“AJ Perri”) and American Residential Services, LLC or American Residential Services of Florida Inc, (“ARS”) (AJ Perri and ARS are collectively referred to as “Sponsors”).
1. Eligibility
The contest is open to legal residents of the United States who are eighteen (18) years of age or older at the time of entry, living in a residence (the “Residence”) within AJ Perri’s serviceable area within the state of New Jersey and ARS’ serviceable areas within the states of Florida, North Carolina, South Carolina, Georgia, Tennessee, Maryland or Virginia (“Serviceable Area”) with a valid email address. To determine whether you live in a Residence within a Serviceable Area, please visit ARS.com. Employees of Sponsors, their affiliates, licensees, franchisees, advertising, and promotional agencies and the immediate family members of each are not eligible. All federal, state and local laws and regulations apply. VOID WHERE PROHIBITED BY LAW.
2. Contest Period
Contest entries must be submitted to respective Sponsor between 12PM CST on March 15, 2021 and 11:59 PM CST on April 30, 2021 (the “Contest Period”). Limit one entry per household. Winners must claim their prize within 30 days of announcement.
3. How to Enter
To enter the contest, fill out the entry form found on the Contest page (located here) no later than 11:59 PM CST on April 30, 2021 while supplies last. All submissions must include your legal name, address, phone number and email and all questions on the entry page must be completed. By entering the Sweepstakes you expressly consent to receiving phone calls from Sponsors to the number provided as well as email and mail newsletters periodically from Sponsors. You can opt-out of receiving email communications at any time by clicking the unsubscribe link in the newsletter.
4. Prize/Winner Selection/Notification/Consumer Disclosure
Sponsors will be giving away a total of ten (10) Nest Learning Thermostats , with installation included (the “Prize”), to eligible contest Winners. Winners will be chosen at random on or about May 1, 2021. Winners are chosen at random and winners will be notified by phone. Sponsors will attempt to contact winner up to three (3) times each. If any recipient does not respond within three (3) days of the final attempt, or should the telephone number no longer be in service after three (3) attempts, the prize will be forfeited and an alternate Recipient will be selected. Winner must schedule the install of their prize, if applicable, within 30 days of notification or the prize will be forfeited.
No more than 10 total Prizes will be given away. Limit one Prize per household. Total Retail Value of each Prize is $399.00 (Total value of all Prizes = $3990.00). The Prizes include purchase and basic installation but do not include the cost of any applicable upgrades or conversions. The odds of winning depend upon the number of eligible entries received, the time in which the eligible entries are received, and/or the number of participants in the contest. No substitution or transfer of prize by winner permitted. By accepting prize, winner agrees to hold Sponsors and their respective subsidiaries, affiliates directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of any prize. Acceptance of prize constitutes permission to the Sponsors and their agencies to use winner's name and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law or parental consent for a minor is not obtained. Entrants agree to release, discharge and hold harmless Sponsors and their respective subsidiaries, affiliates directors, officers, employees and assigns, harmless from and against any and all liability and damages.
By participating in this contest, entrants agree to be bound by these Official Rules. All material submitted becomes the sole property of Sponsors. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the prize or in the announcement of the prize.
5. Entry Conditions and Release
By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and Administrator which are binding and final in all matters relating to this Contest; and (b) indemnify, defend, release and hold harmless the Sponsors, the Administrator and each of their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entrant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of a prize and/or the broadcast, exploitation or use of entry.
Participants are responsible for any costs incurred in participating in the contest, including supplies for creating submission and postage for mailing submission, the maximum costs, including postage and handling fees is dependent upon entry size and format. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of any prize. Sponsors are not liable for any technical failure of the internet, failure to access the internet and/or failure to receive entries. ALL TAXES AND OTHER COSTS ASSOCIATED WITH ACCEPTANCE OF THE PRIZE, AND THE REPORTING CONSEQUENCES THEREOF, ARE THE SOLE OBLIGATION OF RECIPIENT. PRIZES ARE AWARDED WITHOUT WARRANTY OF ANY KIND (EXCEPT AS OTHERWISE EXPLICITLY OFFERED IN WRITING) WHETHER EXPRESS OR IMPLIED, IN FACT, OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
6. Publicity
Except where prohibited by law, participation in the Contest, constitutes each winner’s consent to allow Sponsors’ and their respective agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for advertising and Contest purposes in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission. Winner agrees to work with the Sponsors and their representatives to provide all requested information and materials, within reasonable privacy standards, to execute the aforementioned publicity.
7. General Conditions
Sponsors reserve the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsors in their sole discretion. Sponsors reserve the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserve the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
By participating in this Contest, entrants agree to be bound by these Official Rules. All material submitted becomes the sole property of Sponsors.
